These Terms and Conditions ("Terms") govern your use of the website located at avondaleasphaltpaving.com and your engagement of services provided by Meridian Avondale Asphalt Paving ("we", "us", or "our"). By using our website or requesting our services, you agree to these Terms. If you do not agree, please do not use our website or engage our services.
By accessing this website, submitting a contact or estimate request, or entering into a service agreement with Meridian Avondale Asphalt Paving, you confirm that you are at least 18 years old, have the legal authority to enter into a binding agreement, and accept these Terms in full. These Terms apply to all visitors, customers, and anyone else who accesses the website or engages our services.
Meridian Avondale Asphalt Paving is an asphalt paving contractor offering services including, but not limited to: asphalt paving, asphalt sealcoating, crack sealing, asphalt repair, pothole repair, asphalt resurfacing, driveway paving, parking lot paving and maintenance, parking lot striping, grading and excavation, concrete curbing and sidewalks, asphalt milling, drainage solutions, and speed bump installation.
Services are performed in Avondale, AZ and the surrounding greater Phoenix metro area. All work is subject to the availability of our crews, weather and site conditions, and the terms of a written service agreement or approved estimate.
All estimates provided by Meridian Avondale Asphalt Paving are based on an on-site assessment of the project. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. An estimate is not a binding contract until both parties have signed a written service agreement.
Prices are subject to change if site conditions differ materially from what was observed during the estimate - for example, if base damage is discovered after work begins that was not visible during the initial assessment. In such cases, we will notify you before proceeding and provide a revised price for your approval.
Material costs may fluctuate with market conditions. Any estimate provided reflects pricing at the time of the assessment. We will inform you of any material price changes before work begins.
Once a service agreement is signed and a start date is confirmed, we ask that you notify us at least 48 hours in advance if you need to reschedule. We reserve the right to reschedule jobs due to weather conditions, crew availability, or factors beyond our control. We will notify you as soon as possible in such cases and work with you to find the earliest available date.
If you cancel a scheduled job after a deposit has been paid, the deposit may be non-refundable depending on how much preparation or material ordering has occurred. The specific cancellation terms will be stated in your written service agreement.
We reserve the right to decline or discontinue service for any customer who has outstanding unpaid balances, has provided materially inaccurate information about the scope of work, or has engaged in conduct that creates an unsafe or unreasonable working environment for our crew.
Payment terms for each project will be stated in the written service agreement. Unless otherwise agreed in writing, payment is due in full upon completion of the work. For larger projects, we may require a deposit before scheduling or ordering materials.
Accepted payment methods will be specified in your service agreement. Invoices that remain unpaid past the due date stated in the agreement may be subject to a late fee. Continued non-payment may result in the matter being referred to a collections agency or legal counsel, and the customer shall be responsible for any resulting costs.
Meridian Avondale Asphalt Paving reserves the right to place a mechanic's lien on a property in accordance with Arizona law in the event of non-payment for services rendered.
You are responsible for:
Any warranty on workmanship or materials will be stated explicitly in your written service agreement. Unless otherwise specified in that agreement, no implied warranties of merchantability or fitness for a particular purpose are made.
Warranties do not cover damage caused by: tree roots or underground obstructions not disclosed prior to the job, ground movement from soil settlement or expansive soils beyond normal expectations, vehicle traffic that exceeds the design load of the surface, chemical spills, acts of nature, or failure to follow post-installation care instructions provided by our crew.
Normal hairline cracking from thermal expansion and contraction does not constitute a warranty defect. Asphalt is a flexible material and minor surface cracking over time is expected, particularly in the desert climate of Arizona. Regular maintenance, including timely sealcoating and crack filling, is the customer's responsibility and is necessary to maintain the surface.
To the fullest extent permitted by applicable law, Meridian Avondale Asphalt Paving's liability to you for any claim arising out of or related to the services we provide or your use of our website shall not exceed the total amount you paid us for the specific job giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages of any kind, including lost profits, loss of use, or loss of data, even if we have been advised of the possibility of such damages. Some states do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you in full.
The content on this website - including text, images, and other materials - is provided for informational purposes only. We make reasonable efforts to keep the information accurate and up to date, but we make no guarantees about completeness or accuracy. Pricing, availability, and service details are subject to change without notice.
You may not copy, reproduce, modify, or distribute any content from this website without our prior written permission. You may not use this website for any unlawful purpose or in any way that could damage, disable, or impair the site or interfere with any other party's use of it.
If a dispute arises between you and Meridian Avondale Asphalt Paving regarding services performed or these Terms, we encourage you to contact us first to resolve the matter informally. Most concerns can be addressed quickly by speaking directly with us.
If informal resolution is not possible, the parties agree to attempt mediation before pursuing any other legal remedy. If mediation fails, any legal action shall be brought in the state or federal courts of Maricopa County, Arizona. Both parties consent to the personal jurisdiction of those courts.
Nothing in this section limits either party's right to seek emergency injunctive or equitable relief from a court of competent jurisdiction where necessary to prevent immediate and irreparable harm.
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any claims or disputes arising under these Terms shall be resolved under Arizona law.
We reserve the right to update or modify these Terms at any time. When we do, we will post the revised version on this page with an updated effective date. Your continued use of this website or engagement of our services after any changes constitutes acceptance of the updated Terms.
